When can I go to the Strasbourg Court/ECHR?

You may bring a matter to the European Court of Human Rights within 4 months of exhausting domestic remedies (after all appeals in the national jurisdiction) provided that the matter in question violates any of the rights recognised in the European Convention on Human Rights or in any of its Protocols.

It is important to know that if the application is sent just before the deadline, and the application contains a defect, this does not interrupt the limitation period. In other words, we may be notified of a defect but there may no longer be enough time to correct it.

How can I file an Appeal to the European Court of Human Rights?

The application must be sent, enclosing all evidence, pleadings and judicial decisions including the one that exhausts the judicial channel and its notification, by post to the following address:

The Registrar
European Court of Human Rights
Council of Europe
67075 STRASBOURG CEDEX
FRANCE

It is important to note that the Registry of the Strasbourg Court does not wish to receive the application stapled, bound or otherwise joined together.

What is the procedure of the European Court of Human Rights?

The Court receives many applications per year, but very few are admitted.

Below you will find the procedure of the Strasbourg Court and you can also download the Rules of the Court, which outline the procedure, here:
