As we enter the new year, a series of labour law reforms have been introduced through Royal Decree-Law 16/2013, of 20 December.
Full details of these changes can be found on Red Jurídica Española, but we would like to highlight two in particular:
1. Self-employed business owners, and self-employed directors of commercial companies who hold a controlling interest in the company, are now required to increase their minimum Social Security contribution base, provided that, in either case, they employ more than 10 salaried workers.
With retroactive effect from 1 December 2013, the standard minimum Social Security contribution base for self-employed workers will no longer be the general minimum of €858.60, but will instead be set at the minimum contribution base applicable to salaried workers in contribution group 1, that is, €1,051.50.
It will therefore be necessary to update the contribution bases for all self-employed workers affected by this change.
2. The right to reduce working hours (by between one-eighth and one-half) for the legal care of a minor, which any employee could previously request from their employer until the child reached the age of 8, has been extended to age 12.
